Dealing with False Accusations of Abuse

You're in the fight of your life

The first thing you must understand is that if you are directly involved in an alleged abuse situation, you are in serious trouble. This cannot be underestimated. Once the state (typically Child Protective Services) believes that you have physically or sexually abused someone, the full force of the state's protection act will be unleashed. If you are innocent, the only way to protect yourself is to fight back tenaciously and with everything you can muster.

It's not going to be a fair fight

Fighting a false accusation of physical or sexual abuse will be the most serious fight you've ever been in. You're fighting for your freedom, for the preservation of your family, and for the wellbeing of your children. The considerable resources of an entire state will be pitted against you. Not only that, but much of the evidence they will produce for their case will contradict what you know to be true, yet will appear very convincing and powerful to the court.

You need a legal specialist

To have a chance at winning this fight, you have to counter the evidence the state brings against you. This evidence will be manufactured using faulty "scientific" methods supported by expert witnesses. Not only will you need your own experts to counter the state's, but your lawyer must also be as familiar with this area of law as the experts. If he or she isn't familiar with the issues, the cases, the statutes, and the true nature of the evidence, you will be lucky if you escape with your freedom, your family, and your children's psyches intact.

Are the stakes high enough?  Are your rights important enough? Then you must do everything you can to fight, and that starts with finding quality representation.

A good lawyer just isn't enough.  You need someone with experience fighting false accusations.
